TERMS AND CONDITIONS OF SALE FOR GRUESOME ENTERPRISES MERCHANDISE

 

1.0 Definitions       1.1 In these terms and conditions the following words have the following meanings:

                           1.1.1 'Goods' - The clothing and other goods made available for sale through and as described on the Website

                           1.1.2 'we, us, our, Gruesome Enterprises' – Gruesome Enterprises located in Kitchener, ON, Canada

                           1.1.3 'Website' - the website operated by Gruesome Enterprises

                           1.1.4 'you, your' - the person, firm or company who contracts to buy Goods from Gruesome Enterprises

 

2.0 General           2.1 These terms and conditions are the only conditions under which we are willing to sell the Goods to you. 

                                 These  conditions can only be modified as set out in these conditions or by a variation in writing signed by the owner

                                  of Gruesome Enterprises.

                            2.2 These terms and conditions (including any documents referred to within them) contain all the terms on which we sell the Goods
                                  to you subject to clause 2.3.They supersede any prior promises, representations (except fraudulent misrepresentations),
                                  or implications made.

                            2.3 Where you are a private consumer, nothing in these terms and conditions shall detract from your statutory rights.

                            2.4 We reserve the right to vary or amend these conditions from time to time. We will post a copy of the revised conditions on the 
                                  Website. The conditions in force at the time we agree to sell Goods to you will apply to the contract between us for the sale of
                                  such Goods.

3.0 Orders and
Deliveries               3.1 When an order is placed with us, a response should be sent out within 24hrs.

                             3.2 Subject to availability, we have the right to subsitute items in gift baskets for those of equal or greater value. Baskets may not

                                   come exactly as shown as each one is made to order.

                             3.3 A order is only concluded when we receive payment for an offer of goods on our Website. The Goods listed on the Website
                                   constitute an offer to sell on our part.

                             3.4 We reserve the right to reject an order or payment for any reason. In particular we reserve the right to refuse to accept orders or 
                                   payments from customers outside of Canada or to charge for any additional postage and customs charges incurred by us in
                                   sending Goods outside of Canada.

                             3.5  We will endeavour to issue any Goods we have agreed to sell to you within 10 days of the date of acceptance of the order.
                                   However time of delivery shall not be of the essence of the contract between you and us.

                             3.6  Orders that have been accepted by us will be dispatched by registered or recorded delivery post to the address you have notified
                                   to us.

4.0 Price and
Payment                 4.1 The price for the Goods is as listed on the Website as at the date you place an order. The price may be subject to additional
                                   delivery charges and we will tell you what these are at the time you place your order.

                             4.2 Payment can be made immediately using PayPal (credit cards included). You do not need to have a PayPal coount for credit card

                                  purchases.

 

 
5.0 Shipping            5.1 All CDN domestic orders are shipped via Canada Post Xpress.

                              5.2 All international orders are shipped via Canada Post Worldwide (other options may be discussed prior to placing an
                                    order).

                              5.3 If expedited shipping is needed, please contact us for arrangements.

                              5.4 Gruesome Enterprises is not responsible for customs fees when shipping outside of Canada. We may however, allow you to
                                    prepay custom fees as part of the actual shipping cost and choose a more appropriate shipping method to expedite customs
                                    processing.

 

6.0 Return Policy       6.1 All sales final. If there is a problem found with an order, please contact us immediately to remedy the situation.

 

7.0 Privacy Policy       7.1 We will request certain personal information from you in order to process orders received from you. You are responsible for the
                                      accuracy and truthfulness of such information and you warrant and undertake to us that all such information is true and correct.

                               7.2 We will use your personal information only for the purposes of processing orders from you. We will treat your personal 
                                     information as confidential and we will not disclose it to any third party except with your prior agreement or as required by law.

                               7.3 We may use your personal information from time to time to contact you about our products and services that might be of interest 
                                     to you. If you do not wish to receive such communications please notify us by post, or e-mail to the address given above.

                               7.4 Please notify us as soon as possible if there is any change in your personal details or if you discover any error or inaccuracy in
                                    our records.

                               7.5 By accessing the Website and by placing orders for Goods you agree to our terms for the collection and use of your personal 
                                    information.

8.0 Copyright and
Trademarks              8.1 All material on this Website is the copyright material of Gruesome Enterprises or its licensor. All rights are reserved. The
                                     copying or adaptation of the material on this Website or its incorporation into any other work by any means is prohibited, except
                                     that you may print or download extracts of such material for your personal use. You are not granted any other rights in respect of 
                                     copyrighted material.

                                8.2 All trade marks, service marks and trading names on this Website are the property of Gruesome Enterprises (or its licensor) and 
                                     may not be used, reproduced, published, uploaded, posted, transmitted, modified or transmitted in any way (other than for
                                     viewing the Website or ordering Goods) except with our prior written consent.

 

9.0 Event beyond
our control                 9.1 We will not be liable if we are unable to perform our obligations under these terms and conditions due to the failure of any
                                      machine, data processing system or transmission link or to any circumstances beyond our control (including but not limited to
                                      postal failure, industrial action, war, fire, prohibition or enactment of any kind).
